Terms and Conditions for innopay
Welcome to innopay! We're dedicated to simplifying your payment experience while rewarding you for transactions you make.
Please read and understand these terms carefully before registering, accessing, or using the innopay Services offered through the innopay app. These terms and conditions constitute a legal contract ("Terms of Use") between you and Innopay Technologies Private Limited, with its registered office at 460, Sector 4, HSR Layout, Bengaluru, Karnataka 560102. By proceeding with innopay services, you acknowledge that you have read and agreed to these terms.
1. Definitions
- 1.1. innopay: A digital payments brand owned by Innopay Technologies Pvt. Ltd
- 1.2. "We”, “Us”, “Our” – shall refer to innopay and innopay services.
- 1.3. “You, Your, Yourself, or innopay User” refers to any non-registered individual, registered user of innopay and innopay entities, including but not limited to innopay customers or merchants.
- 1.4. "innopay App": The mobile application provided by innopay for offering its services.
- 1.5. "innopay Services": The services offered by innopay, including recharges and Bill Payments, Banking, Municipal Service, Insurance, Housing Society, Hospital, Education, Clubs/Association, Donation, Gold sale & purchase, including others.
- 1.6. "Commercial Partner": Any individual or entity with whom innopay has a contractual relationship to provide services.
- 1.7. “Gold Partner” refers to MMTC-PAMP India Private Limited, which sells digital gold via the innopay platform and uses our payment solutions for transaction processing.
- 1.8. “Gold Product” means gold offered by the Gold Partner in digital form.
2. Eligibility
2.1. By registering for and using innopay, you represent that:
- 2.1.1. You confirm that you are at least 18 years old and capable of entering into a legally binding agreement.
- 2.1.2. You are not prohibited from using the innopay app and services by law.
- 2.1.3. You are responsible for ensuring that any individual using your account complies with these terms.
2.2. By registering for and using innopay, you represent that:
3. User Responsibilities
3.1. By using the innopay mobile/web apps, you agree to:
- 3.1.1. Use the apps only for lawful and personal purposes.
- 3.1.2. Provide truthful and accurate registration information and keep your account details updated.
- 3.1.3. Be responsible for all activities occurring under your account includes maintaining the confidentiality of your account credentials.
- 3.1.4. Notify innopay immediately if you suspect any unauthorized use of your account.
- 3.1.5. Ensure that all transactions are carried out with valid and complete information.
3.2. Prohibited activities include:
- 3.2.1. Reverse engineering, disassembling, or tampering with the app or its intellectual property.
- 3.2.2. Engaging in fraudulent, unlawful, or harmful activities through the app.
- 3.2.3. Transmitting viruses or harmful software that could damage or disrupt the app.
4. Sign Up and Registration
4.1. To use innopay services, users are required to complete the sign-up or registration process.
4.2. As part of the registration process, users must provide either their mobile number or Google account details.
4.3. innopay reserves the right to request additional documents or information if necessary to verify the user's identity and ensure compliance with regulatory requirements.
4.4. Users agree that all information provided during the registration process is truthful, accurate, and up to date. Failure to provide accurate information may result in limited access to innopay services or suspension of the user account.
4.5. Users are responsible for maintaining the confidentiality of their account details, including login credentials. Any unauthorized activity that occurs under the user’s account is the sole responsibility of the account holder.
5. Transactions
5.1. Payments and Recharges
Innopay enables recharges, bill payments, various banking options, and other services (refer to Section 2.4) using credit cards and UPI. However, you may not use innopay for any illegal transactions, including but not limited to payments for pornography, gambling,gaming and piracy.
- 5.1.1. Important Notes.
- Transactions are irreversible once completed.
- Payments made to incorrect accounts due to user errors are the sole responsibility of the user.
- 3.2.2. Engaging in fraudulent, unlawful, or harmful activities through the app.
- 3.2.3. Transmitting viruses or harmful software that could damage or disrupt the app.
5.2. Gold Purchase
When purchasing gold through the innopay platform, you acknowledge that:
5.2.1. The Gold Partner (MMTC-PAMP India Private Limited) is responsible for the quality, purity, and accuracy of the gold products.
5.2.2. innopay does not set the prices of gold products, as they are based on market rates, and is not responsible for physical gold delivery or any related activities or issues.
5.2.3. You must provide accurate information during the purchase, as innopay will not reverse transactions once initiated.
5.2.4. innopay may impose limits on the amount you can pay for, accumulate, or transfer in gold products. We reserve the right to decline, block, or cancel any transaction that exceeds these limits, which may change based on our internal evaluations. A cooling-off period may also be applied on such transactions without prior notification.
5.2.5. You agree to raise any disputes regarding gold products directly with the Gold Partner.
5.2.6. The Gold Partner is fully accountable for pricing, fulfilling orders, and managing the storage of gold products, whether physical or digital. innopay disclaims any liability regarding the quality or quantity of gold or issues related to the Gold Partner’s services.
5.2.7. The Gold Partner is responsible for issuing invoices, providing warranty cards, and offering post-sale support. All disputes related to these matters must be addressed directly with the Gold Partner, though innopay will assist with issues related to the payment process for your gold transactions.
5.2.8. You acknowledge that the terms established by MMTC-PAMP govern your interactions with the Gold Partner. Please review these terms carefully before any transactions. In case of discrepancies, these Terms will take precedence.
5.2.9. You assume all risks associated with online transactions. innopay does not guarantee uninterrupted or error-free services and provides all information on an "as is" basis.
5.2.10. To the maximum extent permitted by law, innopay disclaims all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. You are responsible for evaluating the accuracy and usefulness of any information provided by the Gold Partner.
5.2.11. innopay is not liable for any indirect, consequential, or punitive damages, including lost profits, business interruptions, or data loss arising from your use of the information provided.
6. Fees
6.1 Users are responsible for any applicable fees for transactions, as displayed at the time of payment. By completing a transaction, you consent to the fees applied.
6.2 innopay reserves the right to change the fees at any time, without prior notice.
7. Account Suspension and Termination
7.1. innopay reserves the right to suspend or terminate user accounts without prior notice if any violation of above terms is detected.
7.2. In cases of fraudulent or suspicious activity, innopay may reserves the right to report such activity to the appropriate regulatory authorities.
7.3. You may terminate your account at any time. However, innopay may retain transaction records for regulatory purposes even after account termination.
8. Privacy
8.1. Your personal data is collected and processed in accordance with our Privacy Policy, which is incorporated into these terms.
8.2. By using innopay services, you consent to the collection,and use of your data as outlined in the Privacy Policy.
9. Limitation of Liability
9.1. innopay is not liable for any indirect, incidental, or consequential damages arising from the use of the app, including but not limited to loss of data or profits.
9.2. The app is provided on an "as-is" basis, without warranties of any kind, including uninterrupted service, accuracy, or error-free operation.
10. Grievance Policy
10.1. Any grievances or complaints regarding the use of innopay services will be addressed in accordance with our Grievance Policy.
10.2. By using innopay, you agree to the time frames and procedures outlined in the Grievance Policy for submitting and resolving complaints.
10.3. innopay will make all reasonable efforts to respond to grievances within the specified time frames. However, response times may vary based on the complexity of the issue.
10.4. Users are encouraged to provide detailed and accurate information when submitting complaints to ensure timely resolution.
10.5. For any grievances, you may contact innopay via the chat feature in the innopay mobile/web app or through our official support email ID provided in the support section of innopay application
11. Governing Law and Jurisdiction
11.1. These terms are governed by the laws of India.
11.2. Any disputes arising from the use of innopay services will be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
12. Updates to Terms
12.1. We may update these terms at any time by posting the updated version on the innopay application website.
12.2. Continued use of innopay services after an update will constitute your acceptance of the revised terms.
12.3. We recommend reviewing the terms periodically for any changes.
